Terms of use
Plain summary, and then the same thing in the detail a lawyer would want: iChecks is a tool that runs checklists you wrote. It is yours to use for your work. It is pre-release software and it is not a certified procedure. Your checklists and your records stay on your device — Argocy SASU never receives them and so cannot lose, inspect or claim them.
Who these terms are between
They are between you and Argocy SASU, the publisher of iChecks ("we", "us"). They cover the iChecks app for iOS and iPadOS, the TestFlight beta of it, and this website at ichecks.argocy.com.
Because iChecks is distributed by Apple, Apple's own terms also apply to the download itself, and Apple's Licensed Application End User Licence Agreement governs your licence to use the app except where these terms say something more specific. If the two conflict on a point about the app itself, Apple's agreement wins — we cannot override it, and are not trying to.
What iChecks is not
iChecks is not a substitute for the operator’s approved or certified procedures. It runs checklists that you or your operator have written; nothing in it is approved by any authority, and where an official procedure exists, that one governs.
This is the most important term on the page, so it is stated as a term and not as a footnote. iChecks does not review, validate, approve or certify the content of any checklist — including the example checklists it ships with, which were written by the developer as a starting point and are meant to be edited or deleted. Deciding that a procedure is correct, complete and appropriate for the situation is your responsibility or your operator's, and no output of the app changes that.
Your licence to use it
During the beta, and subject to these terms, you may install and use iChecks on devices you control, for your own work or your organisation's. You may not reverse engineer it, redistribute the app itself, or remove or obscure the notice above.
The beta is free. There is nothing to buy inside the app and no obligation attached to leaving — remove it from TestFlight and you are done. If and when iChecks is sold on the App Store, the purchase is a transaction between you and Apple, on Apple's terms, and prices will be published before anyone is asked to pay one.
Beta software, and what that means for you
iChecks 0.1 is pre-release. It has not been through the testing a shipped version gets, features listed on the beta page as missing are genuinely missing, and behaviour may change between builds. TestFlight builds also stop working 90 days after they are uploaded, by Apple's design.
One practical consequence, stated plainly: during the beta, do not let iChecks be your only record of something you are required to keep. The app is built to lose nothing — every tick is written the moment you make it — but "built to" is not the same as "proven over years", and there is no sync or export in this build to fall back on.
Your checklists and your records
They are yours. We claim no ownership of, and no licence over, anything you write, import or capture in the app. We also never receive it: this version of iChecks has no account, no server and no networking code of its own, so your checklists and your completed runs stay on your device until you deliberately share one yourself. The privacy policy is the detail.
That cuts both ways. Because we never hold a copy, we cannot recover your data if you delete the app, lose the device, or restore it from a backup that predates your work. Your backups are the only backups.
Feedback
If you send feedback — from the app's About screen, or by email — you are giving us permission to use it to improve iChecks, without obligation or payment. Send only what you are comfortable sharing; a bug report is not a confidential channel, and please do not include commercially sensitive or personal information about third parties in it.
No warranty, and the limits of what we owe you
iChecks is provided "as is". To the fullest extent the law allows, we make no warranty that it will be uninterrupted, error-free, or fit for a particular purpose, and we are not liable for any loss arising from a procedure being carried out, recorded or omitted — including indirect or consequential loss, lost profit, or loss of data.
Nothing here limits liability that cannot lawfully be limited: death or personal injury caused by negligence, fraud, or any right you have as a consumer under the law of your own country. If you are a consumer, those rights stand whatever this page says.
Which law applies
These terms are governed by the law of France, and its courts have jurisdiction. If you are a consumer resident elsewhere in the EU or the UK, this does not deprive you of the protection of your own country's law or of the right to bring a claim in your local courts.
Changes
These terms change when the product changes, and the date at the top of this page says when they last did. A change that materially affects you will be mentioned in the release notes for the build that introduces it, not applied quietly. Continuing to use iChecks after a change means you accept it; if you do not, stop using it and remove it.
